Kaplan/Fios White Paper re: GCs

Ari Kaplan Advisors, in conjunction with underwriter Fios Inc. has issue a white paper  with the results of Kaplan's research conducted with 28 professionals at corporate law departments at Fortune 500 corporations.

Kaplan, who has written for Law Technology News (see "The Damaged Heart," Technology on Trial, October 2006) interviewed 26 associate general counsel and senior counsel. Among his findings:

* 39% of respondents say their GC has little or no involvement in management of EDD.
* 89% of respondents say their legal dept has an EDD response team in place.

* 61% of complanies have completed a litigation readiness assessment, most with the assistance of an outside resource.
*61% do not feel that their companies are "particularly impacted" by the changes to the FRCP.
* 75% say their compaines are at a 7 or higher (out of 10) on how well legal holds are enforced, documented, re-issued and monitored.
* 46% do not have a long-term agreement with a preferred EDD provider.
* 14% engage national EDD counsel; the others use outside counsel for each specific case.
