Thomas Allman: Discovery Subcommittee Report
Thomas Allman offers a summary of a recent meeting of the Discovery Subcommittee (of the Committee on Rules and Practice and Procedure of the Judicial Conference of the United States), which has been charged with evaluating and reporting on the "appropriateness of rulemaking on the subject of preservation and spoiliation."
The subcommittee met on Sept. 9, and the agenda included discussion of over-preservation, inconsistent sanctions, ineffective Rule 26(f) conferences, technology issues (including social media and cloud computing), and more.
